A Charlotte police officer who shot and killed a black man at an apartment complex, touching off several nights of unrest in the city, will not face charges, a North Carolina prosecutor announced Wednesday.

Charlotte-Mecklenburg District Attorney Andrew Murray said Officer Brentley Vinson's actions in killing Keith Lamont Scott were justified.

Scott's family has said he was not armed.

However, at a lengthy news conference Murray displayed a nearby store's surveillance video showing the outline of what appeared to be a holstered gun on Scott's ankle, and he gave extensive details about other evidence that Scott was armed.

Plainclothes officers had gone to the complex about 4 p.m. on Sept. 20 looking for a suspect with an outstanding warrant when they saw Scott - not the suspect they were looking for - inside a car with a gun and marijuana, department spokesman Keith Trietley has said in a statement.

Officers saw Scott get out of the car with a gun and then get back in, police said. When officers approached, they said, Scott exited the car with the gun again. At that point, officers deemed Scott a threat and Vinson fired his weapon.

Scott, 43, was pronounced dead at Carolinas Medical Center. An autopsy report from Mecklenburg County authorities says Scott died of gunshot wounds to the back and abdomen.

Vinson, who is also black, had been with the department for two years at the time of the shooting. He has been on administrative leave which is standard in police shootings.

Scott's family has said he did not have a gun, but detectives recovered a firearm at the scene, police said.

At a Wednesday news conference, Murray played a nearby store's surveillance video that appeared to show the outline of a gun in a holster on Scott's right ankle.

Body camera and dashcam recordings released earlier by the police department did not conclusively show that and city officials were criticized for the length of time it took to release police video of the shooting.

Scott's final moments also were recorded by his wife, Rakeyia, in a video shared widely on social media. She can be heard shouting to police that her husband "doesn't have a gun." She pleads with the officers not to shoot before a burst of gunfire can be heard.

The shooting led to two nights of violent protests, including a fatal shooting in downtown Charlotte the next night. The unrest gave way to several more days of largely peaceful demonstrations, and the city instituted a curfew for multiple nights.

In October, police in North Carolina's largest city invited the Police Foundation, an independent, nonpartisan organization based in Washington, D.C., to review its policies and procedures following the shooting.

The foundation has done similar reviews elsewhere, assessing police in St. Louis County, Missouri, after the unrest in Ferguson, and analyzing the response to the terror attack in San Bernardino, California.

The case was among a series across the country since mid-2014 that has spurred a national debate over race and policing.

A trial is underway in Charleston, South Carolina, for a since-fired white patrolman, Michael Slager, facing 30 years to life if convicted of murder in the death last year of a black man, Walter Scott, shot while running from a traffic stop in April.

A Minnesota police officer who shot and killed Philando Castile during a July traffic stop remains free as a manslaughter case against him proceeds.

Deaths of other unarmed black males at the hands of law enforcement officers have inspired protests under the "Black Lives Matter" moniker.

The Black Lives Matter movement traces its roots to the fatal shooting of 17-year-old Trayvon Martin in Florida in 2012, and gained national ground after 18-year-old Michael Brown was shot and killed by a white police officer in Ferguson, Missouri in 2014.

At a time when many new artists are trying to emulate the soul and swagger of the 1960s, Lee Fields just has to record a new record. This authenticity is on full blast, once again, with Emma Jean, the new offering from Lee Fields and The Expressions on Brooklyn's own Truth & Soul Records.

Having been on the road touring for the better part of the last decade, it's evident that Lee Fields has hit an elevated stride with this album. There's a sharper wisdom in the songwriting – from the having loved, lost, and learned vibe of "Don't Leave Me This Way," backed by crooning guitar and wailing horns, to the sophisticated arrangements and studio acumen that's pared with Lee's straightforward sincerity in "Just Can't Win." And then there's "Magnolia," a cover of a JJ Cale song that embodies the late, great American singer-songwriter and the Tulsa Sound he helped create, that's refreshed with the Lee Fields approach.

Like past releases from this matchless pairing of Fields' warm-and-raw growl and The Expressions' switched-on and sharp musicianship, Emma Jean takes soul music in a familiar, but updated, direction. Mixed and partially recorded at Dan Auerbach's Nashville studio-country soul and bluesy rock are immediately noticeable. It brings a different kind of strut to Emma Jean, but Fields-born and raised in North Carolina-is right at home with the Southern soul sound. In fact, it feels like a natural progression; an organic, refreshingly pure next step.

You'd be forgiven a few years ago if you heard a Lee Fields song and thought it was somebody else: O.V. Wright, The Delfonics, or of course James Brown. But now, with the release of Emma Jean, there is no mistaking a Lee Fields track. A distinct soulful sound and a grown style has been forged between him and The Expressions. His 45 years of recording this music, 5 years deep now with Truth & Soul something has clarified. "He's 65 years old," says Leon Michels, co-owner of Truth & Soul and the man with the production credit on Emma Jean. "he's so focused, and has been working non-stop -he's singing the best he ever has." Emma Jean shows this progression and may prove that Fields, The Expressions, and Truth & Soul may be no longer interested in being contemporary soul music royalty. Instead, they seem more motivated to push this music in new directions and explore it's next steps.

World's oldest living person celebrates 117th birthday


Italy's Emma Morano, the world's oldest living person, marked her 117th birthday Tuesday, blowing out all the candles on her cake.

Beaming at the attention, Morano took in the festivities for her milestone celebration sitting in an armchair in her one-room apartment in the northern town of Verbania, joined by her two elderly nieces, a pair of caregivers and her long-time physician.

She received a greeting from Italy's president, read by an official, wishing her "serenity and good healthy," and appeared for a brief live broadcast on state-run television.

She happily accepted some gifts, including her favorite cookies, which she ate with some milk.

Then she blew out the candles on her cake - not one for every year, but three numerals to show her age, 117 - and quipped: "I hope I don't have to cut it!"

To the assembled well-wishers, Morano said, "I am happy to turn 117," and drew encouragement from her physician, Dr. Carlo Bava.

"Who would have said it?!" the doctor remarked. "When you were young everyone used to say you were weak and sick."

"Yes, yes," she responded.

Another party, including a visit from the mayor and another cake, was planned for the afternoon, after a nap.

Morano, who is believed to be the last surviving person in the world born in the 1800s, became the oldest living person in May.

Italy is known for its centenarians - many of whom live on the Mediterranean island of Sardinia - and gerontologists are studying Morano, along with a handful of Italians over 105, to try to figure out their longevity.

Bava has credited Morano's long life to her genetic makeup, "and nothing else."

Wildfires Reach Dollywood's 'Doorstep'


Guest cabins at Dollywood have been evacuated amid a series of raging wildfires nearby in Tennessee, according to a representative for the resort and the state's emergency management agency.

The news comes as the town of Gatlinburg and nearby communities, including a portion of Pigeon Forge, where Dollywood is located, have come under a mandatory evacuation order.

Dean Flener, a spokesperson with the Tennessee Emergency Management Agency, told ABC News that the wildfires reached "right on the doorstep" of the Dollywood theme park but that firefighting crews managed to stop the blazes from progressing into the park overnight.

So far, the wildfire has burned more than 100 homes in the surrounding area and injured one person. Some 1,200 people were in a local shelter on Monday night and schools in two counties in the affected area will be closed on Tuesday, the agency said.

"We have fire crews on the park working with our team to protect structures," said Pete Owens, Dollywood Director of Media. "There is fire on the ridge near the park."

Owens said the guests in the property's cabins have been relocated.

There was so far no fire in the park, about 8 miles outside of Gatlinburg, as of late Monday night, Owens said.

A representative for Dolly Parton said that everything was OK so far inside the park as of Monday night.

Plane with 81 on board crashes in Colombia


A chartered aircraft with 81 people on board, including a Brazilian first division soccer team heading to Colombia for a regional tournament final, has crashed on its way to Medellin's international airport.

Aviation authorities said there are reports of at least six survivors.

"It's a tragedy of huge proportions," Medellin's Mayor Federico Gutierrez Gutierrez told Blu Radio on his way to the site in a mountainous area outside the city where aircraft crashed.

Aviation authorities said the aircraft, a British Aerospace 146 short-haul plane operated by a Bolivian charter airline named Lamia, declared an emergency at 10 p.m. Monday (0300 GMT) due to an electrical failure.

Authorities and rescuers were immediately activated but an air force helicopter had to turn back due to low visibility.

The aircraft, which made a stop in Santa Cruz, Bolivia, was transporting the first division Chapecoense soccer team from southern Brazil. The team was scheduled to play Wednesday in the first of a two-game Copa Sudamericana final against Atletico Nacional of Medellin.

The plane was carrying 72 passengers and nine crew members, aviation authorities said in a statement. Local radio said the same aircraft transported Argentina's national squad for a match earlier this month in Brazil.

A video published on the team's Facebook page showed the team readying for the flight earlier Monday in Sao Paulo's Guarulhos international airport.

The team, from the small city of Chapeco, joined Brazil's first division in 2014 for the first time since the 1970s and made it to the Copa Sudamericana finals last week by defeating Argentina's legendary San Lorenzo squad.
